AGGREGATOR OPEN DATA LICENCE

The Aggregator Open Data Licence (“Licence”) defines the legal framework that governs the collection, storage, sharing and use of data between the Aggregator, data Providers and data Consumers. This Licence is designed to be simple, transparent and fair to all parties involved in the data-sharing ecosystem.

DEFINITIONS

  1. For the purposes of this Licence, the following definitions apply:

    • “Aggregator” means the subject that collects, stores, processes, displays and redistributes data provided by Providers.

    • “Provider” means the subject that voluntarily shares its data with the Aggregator under this Licence.

    • “Consumer” means the subject that accesses or uses data made available by the Aggregator via API or other means.

OWNERSHIP AND SCOPE

  1. All data provided by a Provider remains the exclusive property of such Provider.

  2. The Aggregator is granted the right to collect, store, process, display, redistribute and otherwise handle the data under the terms of this Licence.

  3. Consumers may use the data strictly under the terms and restrictions of this Licence.

COSTS AND SERVICES

  1. The exchange of services between Aggregator and Providers is free of charge. Each party bears its own operational costs.

  2. The Aggregator may charge Consumers for API access or related services at its sole discretion.

NO WARRANTY

  1. All data is provided “as is”, without any warranty as to accuracy, completeness, reliability or fitness for any purpose.

  2. Neither the Aggregator nor the Providers accept any liability for damages or losses arising from the use of the data.

PROVIDER RIGHTS

  1. Providers have the right to decide whether their data will be:

    • publicly accessible to all Consumers,
    • accessible only to selected Consumers,
    • accessible only to the Aggregator,
    • kept private and available only to the Provider.

  2. Providers may discontinue providing data at any time and may request the Aggregator and Consumers to delete their data. Providers acknowledge that deletion of historical data already downloaded or cached by Consumers may be difficult or impossible to enforce.

  3. Providers may remain anonymous if they choose.

  4. Providers may require attribution. In such case:

    • the Aggregator and all Consumers must display the Provider’s name and a link to a detail page containing the Provider’s data,
    • attribution does not need to appear on overview pages (e.g. maps, lists),
    • the size and placement of attribution may vary depending on display constraints, particularly on mobile devices.

AGGREGATOR RIGHTS

  1. The Aggregator may refuse, limit or discontinue the collection or storage of any Provider’s data at any time.

  2. The Aggregator may refuse, limit or discontinue the delivery of data to any Consumer at any time.

  3. The Aggregator may discontinue its aggregation services entirely at its sole discretion.

CONSUMER OBLIGATIONS

  1. Consumers may use the data only for their own purposes and may not transfer, redistribute, resell or share the data with any third party.

  2. If attribution is required by a Provider, Consumers must display such attribution accordingly.

DATA EXCHANGE CLAUSE

  1. If a Consumer is also an aggregator of the same or similar types of data, the Aggregator may request that such Consumer shares its own data either under this Licence, under another open data licence, or exclusively with the Aggregator.

TERMINATION

  1. Any party may terminate its participation under this Licence at any time by ceasing to provide or use data.

  2. Obligations related to attribution, restrictions on redistribution, and data deletion requests remain applicable to all previously obtained data.

MISCELLANEOUS

  1. This Licence applies to all interactions involving the provision, aggregation and consumption of data through the Aggregator’s services.

  2. By providing or consuming data through the Aggregator, all parties acknowledge and agree to the terms of this Licence.

FINAL PROVISIONS

  1. The Aggregator may modify or update this Licence at any time. If material changes occur, the Aggregator will inform affected Providers or Consumers through an appropriate communication channel.
